Terms of Service

1. Acceptance of Terms

By accessing or using Tensyde ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Tensyde ("we", "us", "our").

2. Description of Service

Tensyde is a web-based 3D scene editor that allows users to create, edit, and export 3D visual compositions. The Service provides:

  • A layer-based interface for creating 3D scenes
  • Various mesh types, materials, and visual effects
  • Image export capabilities
  • Project storage and management
  • An embeddable viewer for published scenes

The Service operates on a freemium model, offering both free and paid subscription plans with different feature sets and limitations.

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate and complete information
  • Be at least 16 years of age (or the age of majority in your jurisdiction)
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Use only one account per person

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized account access.

4. Subscription Plans and Payments

4.1 Free Plan

The free plan includes limited features:

  • Limited number of projects
  • 11 3D shapes
  • Customizable text
  • Personal use only
  • Basic effects
  • 1080p image export
  • Video export

4.2 Pro Plan

The Pro subscription provides access to all features:

  • Everything in Free
  • Unlimited projects
  • Image import
  • Commercial license
  • All advanced effects
  • HD export (2x, 3x, 4x)
  • Publish & JSON export
  • HD video export

4.3 Billing

Pro subscriptions are billed either monthly or annually, at your choice. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You will retain access to Pro features until that date
  • After expiration, your account reverts to the free plan
  • Projects exceeding free plan limits will become read-only

All fees are non-refundable. No refunds will be provided for partial billing periods, unused time, or any other reason.

4.5 Right of Withdrawal

If you are a consumer residing in the European Union or the European Economic Area (EEA), you benefit from a 14-day right of withdrawal from your subscription, without giving any reason, in accordance with Directive 2011/83/EU.

However, by subscribing and using the Service, you expressly acknowledge and agree that the performance of the digital service begins immediately upon subscription. You therefore expressly waive your right of withdrawal once the Service has been accessed or used, in accordance with Article L221-28 of the French Consumer Code.

If you have not accessed or used any Pro features, you may exercise your right of withdrawal by contacting us at [email protected] within 14 days of your purchase.

If you reside outside of the EU/EEA, no statutory right of withdrawal applies. All purchases are subject to the refund policy described in Section 4.4.

4.6 Price Changes

We reserve the right to modify subscription prices. Existing subscribers will be notified at least 30 days before any price change takes effect on their account.

5. Commercial Use and License

Tensyde and all associated code, algorithms, technologies, and designs ("Proprietary Code") are the exclusive intellectual property of Tensyde. We grant you a limited, non-exclusive, non-transferable license to use the Service subject to the following conditions:

5.1 Free Plan Limitations

  • You may use Tensyde for non-commercial, personal projects only
  • You may not sell, license, or redistribute content created with Tensyde
  • You may not modify, decompile, reverse engineer, or attempt to extract the source code

5.2 Pro Plan Commercial License

  • You may use Tensyde for commercial purposes, including client work
  • You may embed and display content created with Tensyde in commercial websites and applications
  • You may include Tensyde content in products or services that you sell
  • You may not resell or redistribute Tensyde itself
  • You may not provide direct access to the Proprietary Code to others
  • You may not use our code or technology to create competing products or services
  • You may not bundle or package the Proprietary Code for redistribution

Any use beyond these permissions requires explicit written consent from Tensyde.

6. User Content

6.1 Ownership

You retain all ownership rights to the 3D scenes, designs, and other content you create using the Service ("User Content"). Tensyde claims no ownership over your creations.

6.2 Uploaded Content

Tensyde allows users to upload content such as images. By uploading content, you agree that:

  • You have the appropriate rights and licenses to upload such content
  • Your content does not infringe any intellectual property rights, including copyrights and trademarks
  • We are not responsible for any user-uploaded content that may be explicit, offensive, or illegal

6.3 License to Tensyde

By using the Service, you grant Tensyde a non-exclusive, worldwide, royalty-free license to use your content as necessary to operate the Service, including reproducing, storing, backing up, and distributing your content. This license ends when you delete your content or account.

6.4 Responsibility

You are solely responsible for your User Content. You represent that you own or have the necessary rights to all content you upload or create, and that your content does not infringe any third-party rights.

7. Acceptable Use

When using the Service, you agree not to:

  • Create or distribute illegal, harmful, or offensive content
  • Infringe on intellectual property rights of others
  • Upload malware, viruses, or malicious code
  • Attempt to reverse engineer, decompile, or hack the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated tools to scrape or access the Service
  • Share account credentials or allow unauthorized access
  • Circumvent any usage limits or access controls
  • Use the Service for any illegal purpose
  • Resell, redistribute, or sublicense the Service or any part of it
  • Use our code or technology to create competing products or services

8. Intellectual Property

All rights, title, and interest in and to Tensyde, including its software, embeddable viewer code, design, logos, and documentation, are and will remain the exclusive property of Tensyde. You may not copy, modify, or distribute any part of the Service without our written permission.

The embeddable viewer and any code provided by Tensyde may only be used to display your own published scenes. You may not redistribute, resell, bundle, or package the Tensyde code for any purpose, nor use it as a basis for competing products or services.

As stated in Section 6, all User Content you create remains your property. Exported images and published scenes are yours to use as you see fit, subject to any third-party rights in assets you may have incorporated.

9. Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Service will be available 24/7 without interruption
  • The Service will be error-free or bug-free
  • Data loss will never occur

To the maximum extent permitted by law, Tensyde shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

10.1 By You

You may delete your account at any time through the account settings. Upon deletion, your projects and data will be permanently removed after a reasonable retention period.

10.2 By Us

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay subscription fees when due

We will make reasonable efforts to notify you before termination, except in cases of severe violations. Violation of these Terms may result in immediate termination of your account and legal action.

11. Feedback and Suggestions

By submitting suggestions, feedback, or ideas regarding Tensyde, you agree that we may use them for any purpose without compensation or attribution to you. You waive any rights you may have in such feedback and agree that we own all rights to use and incorporate your suggestions.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the Service and delete your account.

13. Consumer Mediation

In accordance with Articles L611-1 and R612-1 of the French Consumer Code, in the event of a dispute that has not been resolved through our customer service, you have the right to refer the matter free of charge to a consumer mediator.

Before contacting the mediator, you must first attempt to resolve your dispute directly with us by sending a written complaint to [email protected].

If no satisfactory response is received within 60 days, or if the dispute remains unresolved, you may submit the matter to the following consumer mediator:

14. Disputes

These Terms are governed by and construed in accordance with French law. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Paris, France.
